BANKRUPTCY

Our firm represents clients in two types of bankruptcies, Chapters 7 and 13.

Chapter 7- this is a liquidation proceeding in which the debtor seeks dissolution of certain debts.


It allows for the discharge of many forms of debt, including unsecured consumer debt and some secured debt where the debtor is willing to relinquish their right to any subject collateral.

Additionally, earnings of the debtor once the case has began may be off limits to creditors who had claims on the date of filing.

Chapter 13- this allows for the repayment of debt through a structured plan monitored by the Bankruptcy Court. Through such a plan, the debtor is allowed to keep property, while making regular payments to the Chapter 13 Trustee.

This form is ideal for individuals seeking to catch up on past due secured debts, such as car or mortgage payments, thus avoiding foreclosure or repossession.

SOCIAL SECURITY CLAIMS

Attaining disability benefits can be extremely difficult, even for those who need it most.
