BANKRUPTCY
Our
firm represents clients in two types of bankruptcies, Chapters 7
and 13.
Chapter
7- this is a liquidation proceeding in which the debtor seeks
dissolution of certain debts.
It allows for the discharge of many forms of debt, including unsecured
consumer debt and some secured debt where the debtor is willing
to relinquish their right to any subject collateral.
Additionally,
earnings of the debtor once the case has began may be off limits
to creditors who had claims on the date of filing.
Chapter
13- this allows for the repayment of debt through a structured
plan monitored by the Bankruptcy Court. Through such a plan, the
debtor is allowed to keep property, while making regular payments
to the Chapter 13 Trustee.
This
form is ideal for individuals seeking to catch up on past due secured
debts, such as car or mortgage payments, thus avoiding foreclosure
or repossession.

SOCIAL
SECURITY CLAIMS
Attaining
disability benefits can be extremely difficult, even for those who
need it most. An individual's eligibility is determined by evaluating
various aspects of one's medical condition, work history, and resources.
For this reason, it is wise to allow an attorney to assist you in
dealing with the procedures involved in seeking benefits form the
Social Security Administration (SSA). Typically individuals seeking
disability benefits are applying for either Disability Insurance
Benefits or Supplemental Security Income:
Disability
Insurance Benefits- whether an individual is entitled to these benefits
is hinged upon the period of claimed disability, as well as whether
one has insured status. Insured status is determined by one's earning
record. Based on one's earning record, benefits may be available
under this program to the insured, as well as the insured's spouse,
former spouse, widow(er), or children.
Supplemental
Security Benefits (SSI)- this program was designed to assure a minimum
level of income for individuals who are senior citizens, disabled,
or blind. It is a need-based program for those who do not have sufficient
income to maintain a standard of living at the federally recognized
minimum income level. Eligibility for SSI is not determined by one's
earning history, but rather their income and resources.
To
apply for disability benefits online or to download forms, contact
the Social Security Administration at http://www.ssa.gov
